COMMITMENT TO PRIVACY
At Ever Active Schools (EAS), we are committed to protecting the privacy of our staff, volunteers, Board members, donors, prospective donors, supporters, customers, users of our website and others who have contact with our organization offline and the need to be in control of your personal information. “Personal Information” is any information that can be used to distinguish, identify or contact an individual. The Personal Information that EAS collects includes, but is not limited to: name, email address, mailing address, and credit card information (from our online store and donations platforms). Certain information is excluded from this definition, such as specific business contact information.EAS is obligated to follow and abide by the Personal Information Protection and Electronic Documents Act (PIPEDA, Federal legislation) and Personal Information Protection Act (PIPA, Alberta legislation) in all matters involving the collection, use, safeguard, and disclosure of Personal Information during the organization’s activities. EAS is obligated to always disclose what Personal Information is being collected from individuals and for what purpose the Personal Information is being collected. EAS will not require the collection of any Personal Information if the purpose for its collection is not identified.
This Privacy Policy describes the practices employed by EAS relating to personal information that identifies you (“Personal Information“) and applies to all partners and individuals whose Personal Information is collected, used or disclosed during the activities of EAS. This policy also applies to employees of EAS. For the purpose of this policy the term employees includes students, volunteers, and outsourced agents of EAS
COLLECTION OF PERSONAL INFORMATION
Use of our website may result in the collection of the following Personal Information:
- Contact Information such as name, email address, postal address, phone number
- Demographic Information such as age, gender, location (if provided)
- Non-Commercial Information such as event registration details, survey responses, volunteer information
- Other Information: any information you voluntarily provided
- how you landed on our website
- the websites that you visit from our website;
EAS’ web server automatically recognizes, but does not collect or use, your domain name (IP address). EAS anonymously tracks your visit in order to compile statistical information about the use of our website (i.e. to gather broad demographic information, behaviour on our website).
With the exception of the Personal Information listed above, you may use our website without disclosing your Personal Information. You are not required to provide any further Personal Information as a condition of using our website.
We collect further personal information only when you choose to provide it to us through information requests such as employment onboarding, volunteer opportunities, donations, fundraising events. Certain activities will require you to provide Personal Information in order to participate. For example, activities such as making a donation, purchasing an event ticket, commenting on a blog, entering a contest, subscribing to a newsletter, or purchasing resources, all require limited Personal Information in order to participate. We do not collect any personal health information.
EAS’ partners may collect Personal Information from individuals and prospective individuals for other purposes, provided that documented consent specifying the use of the Personal Information is obtained from the individuals or prospective individuals
USE OF COOKIES
USE OF PERSONAL INFORMATION
We do not sell, rent or loan the Personal Information that you provide to us.
Personal Information in the form of contact and financial information is used by EAS to: (i) process donations; (ii) administer fundraising events, and contests; (iii) provide income tax receipts and event tickets; (iv) keep you informed of EAS’ charitable work, funding needs and opportunities to volunteer and give through reports and newsletters. Contact information is also used to contact you when necessary in order to resolve service issues or questions. If you choose, you may readily opt-out of receiving future communications from EAS. All other Personal Information provided by you is only used for the purpose of supplying you with the service you have requested or for which you have given your consent.
CONSENT
By providing Personal Information to EAS, individuals are implying their consent to the use of that Personal Information for the purposes identified in this Policy.
EAS may collect Personal Information without consent when it is reasonable to do so and permitted by law.
Individuals may consent to the collection and specified use of Personal Information in the following ways:
- Completing and/or signing a PIPA form
- Checking a checkbox or selecting an option (such as ‘Yes’ or ‘I agree’)
- Providing written consent either physically or electronically
- Consenting orally in person
- Consenting orally over the phone
- Implicitly by providing the Personal Information
EAS will not, as a condition of providing a product or service, require individuals to consent to the use, collection, or disclosure of personal information beyond what is required to fulfill the specified purpose of the product or service.
An individual may opt-out of receiving any and/or all communications from us by contacting us at 780-454-4745 or sending an email to privacy@everactive.org.
EAS will not obtain consent from individuals who are minors, seriously ill, or mentally incapacitated. Consent from these individuals will be obtained from a parent, legal guardian, or a person having power of attorney.
EAS is not required to obtain consent for the collection of Personal Information, and may use personal information without the individual’s knowledge or consent, only if:
- It is clearly in the individual’s interests and the opportunity for obtaining consent is not available in a timely way
- Knowledge and consent would compromise the availability or accuracy of the personal information and collection is required to investigate a breach of an agreement or a contravention of a federal or provincial law
- An emergency threatens an individual’s life, health, or security
- The information is publicly available as specified in PIPEDA and/or PIPA
EAS is also not required to obtain consent for the collection of personal information if the information is for journalistic, artistic, or literary purposes.
DISCLOSURE OF PERSONAL INFORMATION
EAS works with certain trusted organizations to act on its behalf by performing such functions as processing credit card payments and hosting our website. Those entities are provided with only the Personal Information needed to perform their specific function and they may not use such information for other purposes. They are bound by contract to maintain the confidentiality and security of personal information and are restricted from using such information in any way not expressly authorized by EAS.
Personal Information will not be disclosed by EAS or contract service providers to third parties except when consent is obtained from the individual to whom such information relates or when required by a lawful authority or where permitted in accordance with applicable privacy laws.
All Personal Information is stored on databases, data processors and servers owned and operated by us, our affiliates or contract service providers. Any affiliate or contract service provider charged with storing Personal Information is required to comply with the terms and conditions of this Privacy Policy.
Some Personal Information may be stored or processed at computers located in other jurisdictions, such as the United States, whose data protection laws may differ from the jurisdiction in which you live. In such cases, we will ensure that appropriate protections are in place to require the data processor in that country to maintain privacy protections that are equivalent or substantially similar to those outlined in this Privacy Policy.
ACCESS TO PERSONAL INFORMATION
You have a right to access your personal information in EAS’ custody or control subject to certain exceptions under applicable privacy law. You may make a request for access to your personal information by writing to privacy@everactive.org. Sufficient information must be provided in the access request to allow EAS to identify the information you are seeking. Unless there are reasonable grounds to extend the time limit, requested Personal Information will be disclosed to the Individual, at no cost to the Individual, within thirty (30) days of receipt of the written request.
DATA RETENTION
Personal information will be retained as long as reasonably necessary to enable participation in EAS’ programs, events, and activities, and in order to maintain historical records as may be required by law or by governing organizations.
SECURITY
We take every precaution to protect Personal Information. When our online registration or donation or ticket forms ask you to enter sensitive information, we use SSL encryption technology to prevent such information from being intercepted and read as it is transmitted over the Internet to our servers. EAS also employs many other administrative, physical and technological security measures such as firewalls, passwords and restricted access to ensure that Personal Information that you provide is protected from unauthorized use or disclosure. However, even with the best available security at a point in time, no method of transmitting or storing electronic or physical data is ever completely secure and therefore we cannot warrant or guarantee that such information will never be accessed and used in a manner that is inconsistent with this privacy statement.

We may provide links on our website to other relevant sites. These sites operate independently of EAS and have established their own privacy and security policies. We encourage you to be aware when you leave our site and to read these policies at any site you visit. EAS is not responsible for the privacy practices of third party websites, which may be linked to our site.
NOTIFICATIONS OF CHANGES TO OUR PRIVACY STATEMENT
If we change our privacy statement, we will post those changes on the privacy page of this website so our users are always aware of what information we collect, how we use it, and under circumstances, if any, we disclose it. We will use information in accordance with the privacy statement under which the information was collected. If at any point we would like to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of an email. Users will have a choice as to whether or not we use their information in this different manner.
